Rezumat:
Ideea protectiei drepturilor fundamentale, în special a protectiei datelor cu caracter personal, s-a dezvoltat în Europa, în cadrul Uniunii Europene și Consiliului Europei. Articolul analizează ipoteza unui posibil succes al reglemntării. Aceasta are în vedere preluarea legislației europene pe alte continente vs. preluarea ideii de protecție a datelor. De asemenea, sunt analizate situații de aplicare a reglementării europene pentru operatori de date din afara continentului.
The idea of the protection of fundamental rights, especially the data protection has been developed in Europe, within the European Union and the Council of Europe. The article analyzes the hypothesis of a possible success of the regulation. This takes into account the takeover of European legislation on other continents versus taking over the idea of data protection. Situations of application of the European regulation for Data Controllers outside the continent are also being analyzed.
