Daniel-Mihail Sandru, Legitimarea vocaţiei statului si a autorităţilor publice de a incheia o convenţie arbitrală (The Legitimacy of State and Public Authorities’ Capacity to Conclude an Arbitration Agreement), Revista romana de arbitraj, nr. 1/2007

State and public authorities (bodies of public law) are legal entities different from traders, the latter being the main participants in (domestic and international) business relationship. Legislative solutions are various, certain legislations provide expressly for the ability of State to conclude (or not) arbitration agreements, while others provide for intermediate formulas, by subjecting the State’s “capacity” to an agreement from government. The State’s ability to conclude arbitration agreements is deemed as an issue pertaining primarily to power, and less to capacity.
